Real Estate Law and Litigation

Real estate law and litigationWhether buying a home, commercial property, or vacant land, we apply a pragmatic approach using our 20+ years of experience and local knowledge to bring our clients the best results. Our business includes representing buyers and sellers of residential and commercial real estate. We negotiate, draft and review contracts, deeds, promissory notes, deeds of trust, and a wide variety of other real estate documents. We work with our clients and real estate brokers during the due diligence process, including review of title commitments with a goal to minimize risks and surprises.

We represent lenders, owners and lien holders in foreclosure actions.

We advise clients in matters relating to trespass, encroachments, survey problems, adverse possession, access disputes, and easements. We draft easements, license agreements, fence and boundary agreements and other legal documents to assist our clients. Because of our long presence in the Yampa Valley (over 30 years) and knowledge of the quirks and characteristics of different properties, we are frequently relied upon to assist when there is a real estate dispute.

We also have extensive experience in real estate litigation, including complex commercial disputes, retail landlord/tenant disputes, quiet title actions, adverse possession, boundary disputes and easements, condemnations and rights-of-way, trespass/nuisance claims, specific performance, escrow/earnest money disputes, realtor commission disputes, and disputes regarding disclosure of known and unknown conditions.
